Police: Man admits gay-bashing attack was hoax

A 22-year-old man who claimed he was badly beaten outside a downtown Missoula, Mont., bar because he is gay actually sustained his facial injuries trying to do a backflip on a sidewalk, police say.

Joseph Baken of Billings, Mont., was charged with filing a false police report after a video obtained by police and the Missoula Independent newspaper cast doubt on his story.


On Tuesday, Baken pleaded guilty in Missoula Municipal Court to the false report charge. He was given a 180-day suspended jail sentence and fined $300, according to the Independent.

Baken initially reported to police that he was attacked early Sunday morning by three men outside the Missoula Club, where he said he had gone to celebrate his 22nd birthday, after asking patrons about the location of a gay bar, according to local media reports.

Pictures of his badly bruised face?quickly?circulated on the Internet and were displayed on the Wipe Out Homophobia Facebook page and other sites. Gay-rights activists expressed outrage at what they thought was a gay-bashing hate crime.

But Baken?s story began to fall apart after the Independent and the Missoula Police Department obtained what appears to be cellphone video footage that shows Baken trying to do a backflip on a sidewalk in Missoula. He falls short during the landing, smacking his face against the sidewalk.

?Video evidence taken by unidentified sources was examined and demonstrates that Joseph Baken caused injury to himself by attempting a backward somersault and striking his head on the sidewalk at about 2:30 AM on Higgins Avenue,? Lt. Scott Brodie said in a statement.

?Joseph Baken was contacted by Missoula police detectives and during a subsequent interview he admitted that the alleged assault against him did not occur as it was reported,? Brodie said.

The decision to charge Baken with filing a false report ?was due in part to the sense of fear and anger that quickly developed after Baken had identified a specific business and possible suspects in his allegations,? Brodie said.

Baken could not be reached by NBCNews.com for comment on Thursday. A phone call to a listing for Joseph Baken in Billings went unanswered.

Baken was a featured background player in the 2011 film "Judas Kiss," billed as "an offbeat contemporary drama on a college campus alive with magical realism."

Carlos Pedraza, "Judas Kiss" writer-producer, had posted the picture of Baken's battered face on the movie's website along with news of the alleged attack. In a follow-up?blog post?on Tuesday, Pedraza said:

"As a journalist, I can now see the initial report raised questions that should have been followed up on before this case rose to the level of national attention that it has (e.g.,?Towleroad?and?Huffington Post). As a person who wanted to believe his friend, I admit my bias: I glossed over these questions because I wanted to support my friend. But reporters shouldn?t have.

I posted the news based on press reports and on the fact that a friend and cast member had been hurt. I stand by that decision because anti-gay violence is all too common, and whether this report is true doesn?t change that. Even though the report was false, it doesn?t lessen the value of the offers of support many people had asked me to relay. I am heartened by their stand that such violence is wrong and should be prosecuted."

"Seinfelding" My Relationships - Art of Manliness

A little history:

When I was in college, I didn't have all that much interest in dating or relationships. I had (and still have) a large number of close female friends who provided me with the right amount of emotional support and girlfriend activities (going for food/coffee, cooking together, watching TV, daily text conversations) to satisfy me. Physical aspects of dating were often taken care of at parties with strangers.

Well, now that I've graduated and moved into the realm of adult life (closer to my 24th birthday than my 23rd), my attitude towards dating has changed. I'm starting to look for an exclusive girlfriend. I've been on many dates in the last year or so with a wide variety of fantastic, beautiful and intelligent girls. Ambitious professionals, starving artists, a farmer's daughter, Christians, Muslims, Jews, Atheists, Democrats, Republicans, Americans, Europeans, Asians....you get the picture.

Despite this, I've never been "seeing" a girl for more than a few weeks. There's always something stopping me from changing that Facebook status and introducing her to my friends. Most of the time it's intangible, even undefinable. Literally my answer when the "let's just be friends" conversation comes up is "I'm just not feeling that romantic connection". I liken it to the romantic trials of the cast of Seinfeld, who always found some silly reason to break up with a girl/guy and remain single and alone.

I tried defining my "perfect girl" on paper, thinking having clearly defined idea of what I'm looking for would help me get over this commitment hump. I realized I was in trouble when this spring I met a girl who ticked all the correct boxes (advanced degree, health conscious, interesting job, enjoys travel, strong family ties, well grounded, intelligent, philanthropic. Blue-eyed brunette to boot) and I simply did not feel any passion. We stopped seeing each other after 3 weeks.

For those of you in exclusive relationships...am I missing something here, emotionally? Or simply expecting too much? Are the close friendships I've developed with girls clouding my judgement of what the proper "romantic" emotion should be? Am I trying too hard?

I'm thinking I'm going to keep plugging on with my current path and just enjoy getting to know all these great girls, but I'm starting to draw unfounded but understandable suspicions from close friends and family about my sexuality, or my quality of character because of my inability to go steady with a girl for longer than a month. (For the record, I've only gotten physically intimate with a few of the girls, the majority of the time we don't move past the first kiss before going our separate ways. In fact, it's usually during the kiss when I realize there's no romantic connection).

Earnings Preview: Groupon to report 2Q results

NEW YORK (AP) ? Groupon's stock is trading at its lowest levels since going public late last year, and on Monday the online deals site will get a chance to show investors that its shares are a bargain, when it reports second-quarter earnings after the closing bell.

WHAT TO WATCH FOR: Groupon makes money by taking a cut from the online deals it offers to subscribers on everything from restaurant meals to Botox treatments and weekend getaways.

Though Groupon is the largest company of its kind, it is still young and its business is still relatively unproven, so investors will look for signs of long-term stability and growth prospects.

The biggest concern for Sterne Agee analyst Arvind Bhatia, who downgraded Groupon on Wednesday, is slowing growth. He thinks Groupon has seen "soft" billing trends in recent months because of the weak economy in Europe and market share gains by smaller rival LivingSocial.

Bhatia cut his rating on Groupon from "Buy" to "Neutral."

WHY IT MATTERS: Groupon is the largest and only publicly traded daily-deals site out there. As a pioneer, its earnings are an important gauge of how this new industry is faring. Investors don't seem too confident ? Groupon's stock has lost more than half of its value since it went public at $20 per share last November amid worries about its business model. The shares have lost two-thirds of their value since the start of the year.

WHAT'S EXPECTED: Analysts, on average, expect earnings of 3 cents per share on revenue of $573 million, according to a poll by FactSet.

In May, Groupon forecast revenue of between $550 million and $590 million.

Gunfire in Egypt's tense Sinai: reports

Gunfire broke out Thursday in the Sinai town of El-Arish, reports said, as tensions simmered after the Egyptian authorities vowed to crush a surge in Islamist militancy in the tense peninsula.

It was not immediately clear, however, if the shooting was linked to the government campaign launched to restore security in the peninsula following a weekend attack on a border post that killed 16 soldier.

State-owned Nile News television said clashes erupted between police and gunmen outside an El-Arish police station, but the official MENA news agency reported that the gunfire was an isolated incident.

A security official "denied reports that the... police station in El-Arish came under fire," MENA reported, in an account backed by witnesses who said they did not see or hear any clashes.

MENA said a man driving an unlicenced car had fired several shots in the air on the street housing the police station, without aiming at it.

The conflicting reports came a day after the military said helicopter gunships were deployed in raids that killed 20 militants in Sinai.

"Elements from the armed forces and interior ministry supported by the air force began a plan to restore security by pursuing and targeting armed terrorist elements in Sinai, and it has accomplished this task with complete success," the military said on Wednesday.

The air strikes in Tumah village -- the first in the peninsula for decades -- came as security forces massed near Rafah on the Gaza border for what they called a decisive confrontation with the militants.

A senior military official in Sinai said "20 terrorists were killed" in Apache helicopter raids and when soldiers from the 2nd Infantry Division stormed Tumah.

The militants had been trying to escape when the helicopter targeted their vehicles.

Other security officials in the north of the peninsula reported air strikes near the town of Sheikh Zuwayid, close to the village.

The fallout from Sunday's attack, the deadliest for Egyptian troops in decades, spread to Cairo where President Mohamed Morsi sacked his intelligence chief and two generals.

Morsi's opponents have used the deadly Sinai incident to attack the Islamist president, whose Muslim Brotherhood has good relations with the Hamas rulers of the Gaza Strip.

Security officials say Sunday's attack against a border guard outpost took place under cover of mortar fire from Gaza.

The militants themselves are believed to be mostly Bedouin, with support from hardliners in Gaza who view even the Islamist Hamas, which condemned the attack, as too moderate.
